Terms of Service

Welcome to 2nd Summit. These terms are the agreement between you and 2nd Summit for using our website, application, and services (together, the “Platform”). By using the Platform, reserving a spot, or joining a membership, you agree to them. Please read the sections on risk, disclaimers, and liability carefully — they limit what we are responsible for.
Who can use 2nd Summit
You must be 18 or older to create an account. You agree to give us accurate information, to keep your account details to yourself, and to be responsible for everything done through your account. We may suspend or close an account at any time if these terms are broken or if we believe it is necessary to protect other members, our partners, or us.
What 2nd Summit is — and is not
2nd Summit curates and lists experiences for adults 50+. Some experiences are organized by us or by a volunteer host or ambassador working with us. Many more are organized and run entirely by third parties — parks, clubs, studios, museums, guides, and other businesses — and we list them so you can find them.
For any experience we did not organize, we are not the organizer, operator, or provider. The organizer sets the price, the schedule, the terms, the refund rules, and the safety standards, and is solely responsible for the experience. We do not verify, endorse, guarantee, or supervise third-party organizers, their staff, their instructors, their equipment, or their insurance. When registration or payment happens on a partner’s website, that partner’s terms and privacy policy govern it.
Listings are compiled from partners and public sources. We work to keep them accurate, but details change — times move, events are canceled, prices differ at the door. Please confirm the details that matter to you with the organizer.
Reservations, waitlists, and cancellations
Reserving a spot holds a place for you and any guests you name. Spots are limited, and reserving is not a guarantee an experience will take place. We or an organizer may change, reschedule, or cancel an experience — for weather, safety, low turnout, or any other reason. If we cancel a paid experience we organized, we will refund what you paid us.
You are responsible for the guests you bring, including making sure they meet any age or fitness requirements and that they follow these terms. Please cancel if you cannot make it, so someone on the waitlist can go.
Payment, seat holds, and refunds for experiences you pay for on 2nd Summit are covered by our payment terms, including the 24-hour refund window. Partner-ticketed events follow the partner’s own rules.
Physical activity, health, and assumption of risk
Many experiences involve physical activity, the outdoors, altitude, uneven terrain, weather, travel, and other people. These activities carry inherent risks — including the risk of injury, illness, property damage, and in rare cases death — that cannot be eliminated no matter how carefully an experience is planned.
You are the best judge of what you can do. You agree to evaluate each experience honestly against your own health, fitness, and abilities, to consult a physician if you have any doubt, to bring what you need, and to follow the reasonable instructions of the host or organizer. Hosts and ambassadors are volunteers and community members, not medical professionals, licensed guides, or trained rescuers, unless an experience says otherwise.
You knowingly and voluntarily assume all risks of participating, and you agree to release and hold harmless 2nd Summit and its owners, employees, hosts, ambassadors, and partners from claims arising out of your participation, to the fullest extent permitted by law. Nothing in these terms releases anyone from liability for gross negligence or willful misconduct, or from anything the law does not allow to be released. We may ask you to sign a separate waiver for certain experiences.
Membership
A paid membership renews automatically each period until you cancel, at the price shown when you subscribe. You can cancel anytime from your account; your benefits continue through the end of the period you have paid for, and we do not pro-rate partial periods. Membership benefits are perks, not guarantees — we may add, change, or retire them, and member pricing or early access applies only where an experience offers it.
Community conduct
Show up for others the way you would want them to show up for you. You agree not to harass, threaten, discriminate against, or endanger anyone; not to misuse another member’s information; not to use the Platform for commercial solicitation; and not to scrape, copy, overload, reverse engineer, or interfere with the Platform or its security. We may remove content, cancel a reservation, or end an account for conduct that puts a member, a partner, or the community at risk.
Your content
You keep ownership of the stories, photos, reviews, and other content you submit. By submitting it, you give us a non-exclusive, worldwide, royalty-free license to use, display, adapt, and promote it in connection with 2nd Summit, and you confirm you have the right to give us that license. We may decline or remove content for any reason.
Photos and video are sometimes taken at experiences. If you would rather not appear in them, tell the host — we will honor it.
Our content
The Platform, the 2nd Summit name and logo, and the text, design, and curation on it are ours or our licensors’, and are protected by intellectual property laws. You may use the Platform for your own personal, non-commercial use. Everything else needs our written permission.
Disclaimers
The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant any third-party experience, organizer, partner, venue, or product you find through the Platform.
Limitation of liability
To the fullest extent permitted by law, 2nd Summit and its owners, employees, hosts, ambassadors, and partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or personal injury arising out of an experience we did not organize. Our total liability for any claim relating to the Platform is limited to the greater of the amounts you paid us in the twelve months before the claim, or one hundred dollars ($100). Some states do not allow certain limitations, so parts of this may not apply to you.
Indemnification
You agree to indemnify and hold 2nd Summit harmless from claims, damages, and reasonable legal costs arising out of your use of the Platform, your participation in an experience, your content, or your breach of these terms.
Disputes and governing law
If something goes wrong, please email us first — nearly everything is solved that way. These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules, and any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Denver County, Colorado.
Changes to these terms
We may update these terms as 2nd Summit grows. If we make material changes, we will post the updated terms here with a new “Last updated” date. Continuing to use the Platform after that means you accept the updated terms.
